建構跨法域（大陸與港澳地區）自由貿易區商事爭議解決機制之構想

Envisioning a Commercial Dispute Resolution Mechanism within (Mainland China, Hong Kong & Macau) Free Trade Zone

摘要

隨著港澳的回歸及區域經濟的快速融合發展，粵港澳區域更緊密合作的概念已經提出多時，但至今尚未完全落實，其中區內法院衝突問題複雜。借著中華人民共和國國家發展和改革委員會公佈《珠三角洲地區改革發展規劃綱要2008～2020》和大陸「十三五」期間更加重視對外開放和區域合作的契機，在研究建立粵港澳自貿區的同時，筆者通過研究大陸與香港現行法律關係，提出探討自貿區的獨立法律機構及建構自貿區商事爭議解決機制的一些構想，希望以新思維新角度去解決積累已久的區域司法難題，亦對解決其他同類跨境、跨法域法律問題起參考作用。

The idea for closer relationships has been rapidly developing within the region of Mainland, Hong Kong and Macau. However, in legal aspect, the regional legal system and conflicts of law is much more complicated than economic co-operations. Taking the opportunity that the Beijing government is reviewing and re-developing the free trade zone policy across the Guangdong and pearl-river delta areas, this article envisions the idea for a cross-jurisdictional commercial dispute resolution mechanism within the Free Trade Zone area.
