摘要

本文的目的主要在探究民主「治理」的內涵以及嘗試利用「層次分析」的概念，探討政策過程可用的治理與政策工具，以提供政策設計與執行時，一個更為完整與系統的概念架構。面對政策系絡的複雜性和不確定性，預期運用單一制度性架構達成政策目標，是不切實際且不夠周全；亦即不論司法、市場、政治性途徑，抑或新近所謂的政策網絡研究皆可視為新治理架構的一環，亦皆為政策設計時必須審慎思考的有用機制。因此，對於新治理架構的發展而言，上述任何一種機制各皆有其功能與不足之處。今日新治理的議題已非何種政策制度或工具擁有絕對的優勢，而是如何針對不同的政策議題與環境，結合不同的策略性制度工具與社會公民團體，共赴事功。

Coping with the complexity and uncertainty of policy context, it is unrealistic and incomplete to utilize a particular political or societal institution for achieving expected policy goals. In order to offer a systemically conceptual framework for the efficacy of policy design and implementation, this study intends to explore the conception of democratic governance and use the concept of level analysis to connect varied governance instruments in policy process. To be properly responsive to societal needs and demands and deal with social problems effectively, government and public bureaucracies must be concerned with the whole range of policy instruments and institutions for collective action available to a modern society. These institutions include all government levels, market, and the courts, as well as policy networks.
