基層警察跨區域犯罪偵查合作之困境

Predicament of Cross-Jurisdiction Criminal Investigation of Street-Level Detectives

摘要


基層警察在犯罪偵辦上,面對千變萬化的案情與線索,非常仰賴在地資訊,以期有效打擊犯罪。本文針對警政內部組織,採質化研究途徑,從正式制度、社群生態、與日常互動之視角,探究基層犯罪偵查合作與跨轄區合作的實況情境,並透過行動情境論所突顯的制度環境、互惠理論,指出合作之主觀條件,及資源不足的基層偵查環境。研究結果指出,雖然基層警察發展出獨特的偵查社群,使其能夠有效地應對進退、讓犯罪偵查可預期化,同時卻相對減弱跨區域合作的社會條件。

The purpose of this study attempts to investigate the local police organization in terms of its formal institutions, community ecology, and every-day-life interaction. Qualitative approach is employed to explore the actual situation between local and cross-jurisdiction criminal investigation cooperation. The results show that street-level police forces have developed specific detective communities to encounter challenges or difficulties, which is beneficial for them to manage different cases, and also makes criminal investigation predicable. However, it may hurt the social conditions promoting cross-jurisdiction investigation cooperation.
