1984年勞動基準法公布實施後,國營事業工會從本文所謂的「形式保障期」進入「形式預言期」,換言之,工會的形式逐漸地實現其原先內隱的預言,而在團結權、爭議權及協商權三方面均產生了重要的變化。本文之目的在於分析從1984至1990年這段時期的變化過程,研究結果指出:過去國民黨長期掌控國營事業工會,各種提案之建議有如「狗吠火車」,1988年石油工會「勞方連線」利用工會原有的形式之便,串聯團結入主工會。爲了改善勞動條件,以「要拚才會贏」的信念,行使爭議權,發動國營事業工會首次走上街頭的「七一五」行動。以國營事業不合理制度,而非以高級主管爲抗爭對象,尋求管理部門與工會的共同目標。獲得資源之後,發生所謂的「勞勞糾紛」,使團結權面臨考驗。至於協商權的行使仍然處於形式對話的情況,僅有部份的實質功效。
The public-enterprises unions in Taiwan got into the form-prophecy period from the form-protection period in 1984. The purpose of this study is to explore the change process of three labor rights from 1984 to 1990. The results show that most of the suggestions of the unions were neglected by the management, so the members of ”united-line of labor” made use of the channel of the formal-union to win the seat of the president of union in 1988 and held the first demonstration of the public-enterprises unions in Taiwan at 15, July. After they met with success, it occured the ”labor-labor dispute”. As to the exercise of the negotiation rights, it still stays in a stage of little substantive function.
