牙周手術同意書之法律意義

『獲告知的醫療同意權』意指患者有知曉其病情、病況及醫療方法並自由做出接受治療與否之選擇。自八十九年十月起，申請牙周骨膜翻開術之健保給付需檢附牙周手術同意書，證明醫師已明確告知患者施行手術的原因、性質、部位、成功率、術後情況、可能之併發症及危險、手術以外之其他選擇等，由患者本人在完全明白其內容後自由決定是否接受治療。同意書須在患者自由意識下、不可以欺騙、強迫或誤導、隱瞞的方式取得。此外，醫療同意書應詳實載明手術之關鍵訊息，若未善盡說明義務導致病人受到傷害則醫師必須負損害賠償之責。
