談警察人事一條鞭制度之研究

Research on the Whip System of Police Personnel System

摘要


去年世大運開幕時由於反年改陳抗活動,導致了多國代表隊無法進場的窘境,在世大運結束後,因為此一事件,原警政署署長陳國恩被調為國安局副局長,臺北市政府警察局長邱豐光被調為警政署副署長,警政署署長則由原高雄市警察局長出任,如此的作法一般均認為乃是一種懲處,但在換人過程中,臺北市長柯文哲認為並不被尊重,爭議之點在於警察人事一條鞭制度。人事一條鞭制度為我國行政管理上的特殊制度,其中主計、人事以及政風人員均屬所謂的業務輔助單位。而警察為業務機關但是其人事也是中央一條鞭,如此作法造成對地方自治的一定影響。因為直轄市長與縣市長對於警察機關首長沒有人事權,則無法有效掌握警察的管理。對此我們可以參考德日的經驗,取得兩者平衡之處。

The former Taichung police department commissioner took over the position from Chiu Feng-kuang, who was appointed deputy director-general of the National Police Agency. Some have viewed Chiu's transfer to a post that holds very little power as punishment for his mishandling of the Taipei Universiade's opening ceremony year, when protesters broke through police lines and delayed the opening ceremony's. According to Art. 14 of Local Government Act, special municipalities, counties/cities, and townships/ cities are local self-governing bodies, shall carry out self-government matters in accordance with this Act as well as the matters commissioned by higher government agencies. The police agency also belongs to the local government. However, the mayor cannot decide who is the police chief. How to solve this problem is the focus of this article.
