摘要

蘇格蘭的繼受羅馬法主要表現爲學術化蘇格蘭法的形成過程，而經典法律著述則是學術化蘇格蘭法的代表。經典法律著述的產生和成熟是學術化蘇格蘭法發展的主線，從中可以清楚地看到繼受羅馬法是如何步步深入。最後通過法學教育和司法實務可以觀察到以經典法律著述爲代表的學術化蘇格蘭法已成爲法律體制的核心。雖然蘇格蘭的繼受羅馬法有其特色，但其本質與歐陸的繼受羅馬法是一致的，即「法律體制的學術化」。

The formation of academic Scots law is the major expression of the reception of Roman law in Scotland. And Institutional Writings are the essence of academic Scots law. The birth and evolution of Institutional Writings is the central clue of the formation of academic Scots law. The reception advances gradually through the development of Institutional Writings. At last through legal education and practice we find that the academic Scots law becomes the centre of legal system. Though there are several traits in the reception of the Roman Law in Scotland, its essence, academicization of legal system, is identical with that of the Reception in continental Europe.
