歐洲憲法與歐洲聯盟會員國投票表決程序之探討

摘要

歐洲憲法已於2004年10月經歐洲聯盟25個會員國代表共同制定完成。回顧歐洲聯盟之發展過程：從巴黎條約至歐盟制憲歷經50餘年。歐洲新憲法全文448條，分為4大章，憲法內容涵蓋歐洲聯盟體系與運作、會員國權力分配、共同政策制定與施行、歐洲價值捍衛及人權保障等問題。目前25個會員國紛以國內投票表決，以完成歐洲憲法正式生效前之法定程序。本文將以歐洲憲法制定之重要進程與意涵、歐洲聯盟權限、標誌象徵及共同政策目標、及25個會員國表決歐洲憲法程序等，分別加以探討。

The European Constitution has been completely established by the twenty-five state members of the European Union on October, 2004. To recall the development of the European Union: It has been over fifty years from the Paris treaty to European Constitution. The New European Constitution contains 448 articles, four main chapters, covering the systems and the operations of the European Union, power distribution and authority allocation of the state members, establishing policies and practice, combating the European general values and human rights etc. At present, the twenty-five state members have gradually completed domestic voting to accomplish the legal procedure prior to the effectiveness of the European Constitution. This research is focused on the consequence and the significance of the establishment of the European Constitution, the power distribution of the European Union, and its main objective of the twenty-five state members of the European Union.
