經濟全球化的演變,促使台灣的產業結構面臨重大的改變:傳統產業式微,高科技產業與服務業崛起。高科技產業與服務業擴充時,對於高階職務人力也有相對性的需求,當國內高階勞動無法完全滿足產業時,就必須對外輸入高階人力。本文乃透過「實際案例分析」的方法,針對目前引進外國專業人員的違法案例加以剖析與歸納,並探討其各種違法狀況的原因,最後文所欲探究之引進外國專業人員違法狀況可歸納有聘僱行爲違法、就業服務行爲違法、申請行爲違法、及使用行爲違法等4 項;另在違法原因方面有申請資格不符、投機心態的作祟、「望子成龍、望女成鳳」驅使、市場極高度的競爭性與不穩定性、回扣策略的影響、學位證書等文件認證不易、文件的查核未作宣導與協助、及藍領漂白等8項爲主要造成違法之原因。
Under economic globalization, the industrial structure of Taiwan has been greatly changed. Traditional industries are declining, and high-tech industries and service sector are rising. With the expansion of high-tech industries and service sector, when the high-level labor force cannot fully meet the demand, it is required to input high-level labor force from other countries. Therefore, this study mainly analyzes illegal cases of foreign professionals and the reasons behind, and eventually finds out the condition of illegal use of foreign professionals. Violations can be categorized into illegal employment, illegal service, illegal application and illegal use. And there are 8 reasons of violations: nonconforming qualification for application include, speculator's attitude, the drive of expectation on sons and daughters to be talents, extremely high competition and instability of the market, impact of the kickback strategy, difficult certification of diploma, careless check of documents and blue-collar workers pretending to be white-collar workers.
