建築物外牆整建更新之法令制度與關鍵因素分析

摘要

本研究探討目前台灣政府推廣屋齡逾20年以上的老舊大樓外牆拉皮補助計畫，包括：1.內政部營建署98年度「城市風貌整建示範計畫」、2.台北市政府98年度「台北好好看之系列計畫三」。探討面向則針對補助計畫的內容與要點：法令制度面以計畫內容、申請流程、補助項目、優先補助原則等為主，並配合國外的外牆整建更新法令制度與補助計畫內容進行比較，另輔以受內政部營建署、台北市政府之計畫補助，共計30件的外牆整建更新工程案例，予以實證分析，而本研究發現國外的體制設計並非僅單以一般民眾或建物實際狀況作為考量觀點，對於社福單位、弱勢團體的補助措施亦有相當建樹，其對於制度上的設計、訂定乃至於補助的方式、項目、來源，深具多元活化之應用；關鍵因素面乃分別以使用者（所有權人）、民間施工廠商及工程主辦機關的觀點，透過專家訪談，探討外牆整建更新工程的施工過程中，普遍且容易產生影響的因素與程度，而研擬出外牆整建更新工程施作與否的5個誘因、5個限制條件。另詳實記錄研究案例於施工期間各個作業階段的影響因素，包括：使用者（所有權人）於施工前的申請流程、民間施工廠商於施工中的施工過程、工程主辦機關於施工後的辦理程序，建構出上述三方不同觀點的16項關鍵因素，包括：使用者（所有權人）觀點考量因素，經濟性、整合度、生活環境與品質、補助計畫、整建技術；施工廠商觀點考量因素，時程、建材永續性、建築物結構影響、環境影響、材料功能性、保全；主辦機關觀點考量因素，計畫成效、建築永續使用、公共安全、經濟發展力、示範宣導性。透過本研究不僅可了解目前台灣政府於推廣外牆整建更新的法令制度、實施計畫與執行現況，亦可提升使用者（所有權人）或一般民眾對於外牆整建更新法令的基礎認知。

This study discussed the building external walls renovation subsidy program promoted by the Taiwanese government for buildings over 20 years old. The contents of the subsidy program include: 1) laws and regulations: including the program content, application procedures, subsidized items, and principles for priority subsidy; comparison is conducted with several other countries of building external walls renovation laws and regulations' 2) key factors: from the perspectives of users, contractors, and construction authorities, as well as expert interviews, to explore the essential factors in the process of building external walls renovation. Five incentives and five limitations are derived from building external walls renovation, and 16 key factors in three different perspectives are found. This study provides an understanding on the laws and regulations, implementation program, and current state of building external walls renovation promoted by the Taiwanese government.
