我國廉政機制變革之研究

A RESEARCH ON THE ANTI-CORRUPTION SYSTEM IN TAIWAN

摘要


民眾期盼社會公正、公平,更殷切希望國家能擁有一個廉能的政府,以確實保障人民的權益。 「廉政」是攸關國家進步與發展的關鍵,也是各國執政當局極為重視的課題。對於臺灣而言,民眾對政府廉能的信任感,近年來有逐漸下滑的趨勢。綜窺整體的公務部門,仍有眾多人員涉及品德操守的疑慮,也正突顯貪腐行為的嚴肅性;政府執行廉政的機制,亦受到強烈質疑,而須進行其整體檢討。 本研究先從民眾對政府廉能的信任感下滑,及重大貪瀆弊案接連的發生,突顯廉政機制的效能顯然產生問題;繼而深入分析我國在五權與威權體制的發展下,主要的廉政組織調查局、檢察署、政風機構及監察院等機關,試圖釐清其廉政組織的發展脈絡。第三章在分析威權轉型後的民主化對廉政機制的影響,及其面對現代化、績效化、透明化趨勢下的挑戰;其次,本章亦分析各廉政組織,在威權轉型後的發展困境。第四章從廉政的意涵與國家發展的關係,探討廉政機制變革,應以務實與符合效能為構思方針。除了參考亞洲國家成功的作法外,本章並針對法務部成立廉政署、中央行政機關組織基準法等,分析其對廉政機制的影響,研擬廉政機制的變革策略。第五章在因應內外環境變遷,從政經特性理論,就廉政結構面與功能面的觀點,探討廉政機制應有的定位,研擬政風組織變革方案,整併中央與地方廉政機制,調派檢察官偵辦重大貪腐案件,及其他廉政機制變革的可行方案,以建立一套完整健全的廉政機制。第六章總結各章分析結果,並試提可行的政策建議,以為廉政機制變革的參考。

“Incorruption” is a key to a country’s advancement and development, and a quite important issue for the authority in every country as well. Take Taiwan for example, people’s confidence to the government’s integrity is decreasing year by year recently. Have a look at the whole public systen, there are still problems for many officers’ morality and ethic, and it reflects the seriousness of corruption. The way government enforces for fighting corruption is highly doubtful, and need entirely review. This research begins with the decreasing of confidence to our government’s incorruption, and the serious corruption case happened continuously, to reflect the problems in the efficiency on the anti-corruption system. Then, thoroughly analyze the situation that under the development of five authorities and power system, the development and change of the main government anti-corruption organization, such as the Publisher of Prospect, District Prosecutors Office, the Government Employee Ethics Units, the Control Yuan, to clarify the details of its development. In Chapter 3, I am going to analyze the affects from democratization after the change of power to anti-corruption system, and also the challenge when facing the trend of modernization, performance, and transparency. Secondly, this chapter also analyzes each anti-corruption organization’s difficult position after the change of the power. In the Chapter 4, I go into the relation between the meaning of incorruption and country development, to investigates that the reform of incorruption should take practicability and efficiency as the conceptive policy. Not only take Asian country’s successful method as the reference, but also aimed at that Ministry of Justice Department, established the Anti-Corruption Organization, Central Executive Governmen Organization Standard Law….etc, analyze the influence to anti-corruption system, and draw up its reformation strategy. In the Chapter 5, in order to meet the change of inner and outer environment, I use the politics and economics theory, in view of the both aspects of structure and function for incorruption, to investigate its proper position and plan the reform scheme to integrate the public and local’s anti-corruption system, and assign the procurator to investigate the serious corruption case and other workable plan for establishing a complete and well anti-corruption system. Chapter 6 concludes the result of each chapter, and tries to propose the workable strategy and suggestion to be the reference on the anti-corruption system.
