雲林縣警察局實施農機具刻烙碼前後之成效分析

摘要

德國刑事政策學家Liszt指出：「最好的社會政策往往亦是最好的刑事政策」，而刑事政策也就是藉法律來具體化。因應於臺灣農機具竊盜發生率的逐漸攀升，內政部警政署函頒「試辦農漁牧機具防竊刻碼」執行計畫藉以減少失竊率。經雲林縣警察局實施後發現，該縣係屬於農業大縣，有關農漁牧機具失竊問題殊值重視，故為減少農民財產損失，即自行制訂執行計劃，並於民國97年12月5日起無限期於雲林縣各鄉鎮市全面實施，擴大此項服務。本研究以雲林縣警察局執行該政策性工作後對農漁牧機具及電纜線的竊盜發生率是否有其成效，進而探討其成效對於農漁畜牧業者之生計的影響。
本研究首先以文獻探討法與參與觀察法解析雲林縣警察局針對實施「農漁牧機具防竊刻碼」之成效結果，透過相關文獻的分析，尋求歷史資料、檢視歷史紀錄並客觀地分析、評鑑這些資料的研究方法，並藉以實際參與及觀察的角度，探討政策實施之意涵，並以差異中之差異法將實施政策後之受政策實施影響族群視為實驗組，而將未受政策實施影響之族群視為對照組，嘗試釐清此政策之效果。
研究結果顯示，在該政策的執行下，雲林縣轄內的農機具及電纜線的失竊情形確實有顯著性的降低，這也表示該項政策的執行確實有助於農漁民的生計產生效益，且有利於警察在查緝贓物時「查贓緝犯、緝犯追贓」。相對的以該種「刻烙碼」印記的方式標示在物件財產上，更有助於竊盜犯罪的犯罪意圖降低。

To cope with the increasing loss rate of the agricultural machinery and tools, the Taiwanese government has implemented the so called "the Agricultural and Fishing Herd Machines and Tools against to Steal in view of the Implementation Engraves the Code" program in 2009. The objective of this program is to reduce the loss rate of farmers’ agricultural machinery and tools, which is consequently to sustain the wellbeing of the farmers. The primary aim of this study is to make possible contribution to this policy issue by using the administrative data released by the police stations in Yunlin county of Taiwan to empirically assess whether this program achieves it policy goals or not.
Our empirical analysis relies on the approach commonly used in the program evaluation literature. The difference-in-differences (DiD) method was implemented to isolate the net effect of the program. The findings suggest a policy prospect of the program. The implementation of the program successfully reduces the loss rate of the agricultural machinery and tools in the Yunlin county. A more aggressive policy implication can be inferred from this study. Instead of using extensive policy manpower to investigate potential crime, the agricultural engraved brand system can also achieve its policy goals.
