歐洲聯盟對中國大陸法治建設援助之研究

The Actions of the European Union on Rule of Law Promotion in China (1985-2013)

摘要


歐盟對中國大陸之發展援助始自1985年,合作領域漸從技術擴展至治理。然而,2011年歐盟宣布將從2014年起停止對中國大陸之雙邊援助,時值歐中雙邊援助結束之際,正適合通盤回顧歐中發展合作。本文的研究聚焦於歐盟對中國大陸之法治援助,藉由探討法治計畫之內容與進展,瞭解歐中發展合作關係之演進,並且運用國際關係理論解釋歐中法治合作,以歸納出歐中法治合作之要素。 本文先蒐羅所有歐中發展合作計畫,並依據計畫特色將整體趨勢分為「起步期」、「成長期」、「成熟期」與「轉型期」等四個階段,再依法治定義篩選出法治計畫,接著詳述個別合作項目之內容,最後以國際關係理論檢視法治合作過程。本文研究發現,歐盟在中國大陸推行法治之目的為促進民主化,但是歐盟並未掌握合作主導權,而是受制於中國大陸的合作意願。由於歐盟在合作過程中無法施展權力,為新現實主義解釋力之侷限;歐中法治合作亦未產生共同認知,為社會建構論無法詮釋之處;僅新自由主義最能解釋歐中發展合作之互利關係,以及法治合作制度化、制度在地化的要素。

European Union cooperation programs with China, which began in 1985, have been broadened to encompass economic and social spheres. Nevertheless, in 2011, the EU decided to stop all bilateral aid payments to China starting in 2014. This thesis reviews the overall EU-China development cooperation and specifically highlights the rule of law programs. By examining the content of the rule of law programs, this thesis shows the progress of EU-China cooperation relation, and then analyzes the evolution by the international relation theories. Findings from this thesis reveal the EU’s purpose of democratizing China. However, the EU’s actions were circumscribed by China’s cooperation willingness. Neither does Neo-realism explain why the EU was unable to exert power over China during the cooperation, nor does Social Constructivism explain why the cooperation did not lead to shared ideas between China and the EU. This thesis concludes that only Neo-liberalism provides a satisfactory explanation of the mutual interest, institutionalization, and localization of the EU-China rule of law cooperation.
