摘要

本研究主要是以兒少安置機構為例，探討在公私協力下契約關係對非營利組織經營管理產生不同面向的影響，包含宗旨使命，策略以及運作三個面向，以及維護服務使用者權益。
本研究採用質性研究的深度訪談法，共訪談了與南投縣政府有簽訂契約的五位兒少安置機構之主管人員。全部的機構一致認為與政府的合作必須建立在契約的基礎上，亦即，契約關係的確是兒少安置機構與公部門產生互動關係的重要因素，正向結果會是在契約維繫下，可以保障公私雙方的權益以及權責發生之依據，負向結果是受制於契約關係，機構漸漸失去公部門所缺乏之彈性化。
本研究重要發現有三：
1.每個兒少安置機構都非常清楚定位與宗旨使命。
2.以福利服務需求的專業思維導向維護服務使用者最佳利益。
3.每個兒少安置機構本身都有豐厚的社會資本。
最後本文從研究契約關係對非營利組織的經營管理影響，提出對政府政策面、實務面以及未來研究之建議。

The objective of this study is to use child-adolescent residential institutions as an example and investigate the effects of contractual relationship established under a public-private partnership on various aspects of nonprofit organizations, including their missions, strategies, operations, and protection of user rights and benefits.
The in-depth interview method for qualitative research was adopted. The subjects were managers in five child-adolescent residential institutions having a contract with Nantou County Government. It was commonly agreed among all of the subjects that any cooperation with the government should be built upon a contract. In other words, contractual relationship is a key factor of the interactions between child-adolescent residential institutions and the government. The positive outcomes of the relationship are that the rights and benefits of both parties can be assured and there is a foundation for attribution of responsibilities. The negative outcome of the relationship is that due to contractual constraints, nonprofit organizations may gradually lose its flexibility which is absent in public departments.
In this study, three major findings were obtained, including
(1) each child-adolescent residential institution has clear knowledge of its position and missions;
(2) the orientation toward satisfaction of welfare needs can help protect the best interest of users;
(3) each child-adolescent residential institution possesses a high degree of social capital.
Finally, based on the effects of contractual relationship on operation and management of nonprofit organizations, this study provided suggestions in the policy and practical aspects to the government as well as directions for future research.
