新北市社會救助行政審查爭議與權衡

本研究主要以社會救助制度之執行層面出發，以新北市低收入戶及中低收入戶審查人員為研究對象，瞭解其在實務經驗上的執行情形及裁量相關影響因素。本研究透過質性研究之深度訪談以收集資料，綜合研究參與者在相關議題之認知、詮釋與意見並納入研究者的觀點，藉以描繪低收入戶及中低收入戶行政審查人員在實務審核上執行情形，共有8位受訪者參與。研究發現，審查執行困境上，在適用標準的認定以及執行程序上的困難。而影響評估因素部份，發現在個人因素中，個人工作經驗、個人生活經驗及價值觀皆會影響評估結果，而審核過程中，會參考團體、同儕、單位主管及高階皆會對評估結果造成干預，另審核人員主要遵循社會救助法、新北市政府社會局所訂原則來進行，也易在了解實際生活後產生依個案判斷的情形。由於社會救助法規定可看出，法的制定仍無法涵蓋家戶實際狀況，評估排除也面臨執行上的困境，仍須針對實際家戶生活情形進行了解，以對照現行法規闕漏處，並依家戶福利需求設計相關配套措施，以避免有實質需求之家戶無法獲得協助。

The main purpose of this is to verify the influence of the revision of ＂The disputes and balancing of Administrative Examination of Social Assistance Act in New Taipei City＂. This research takes New Taipei City citizens as the object. Using depth interviews, comprehensive research worker in the cognitive-related issues, interpretations and opinions and incorporate the views of researchers, in order to describe the low-income households and medium and low-income population in the administrative review of the audit staff on the implementation in practice situations, there have 8 people participate in interviews. The finding shows, execute investigate predicament, however the difficulties of operating the procedure and uncertainties for applying criteria are disadvantages . Of personal factors ,personal career experiences , life experiences, and values would have impact on the decision-making. Of the referent group , colleagues, supervisors, and higher superintendents make different. And of situational evaluation, social workers follow the principals drew bt the department of welfare of New Taipei city government, but also make the judgment after evaluating the cases. After the reform of Public Assistance Act, there is still long way to go. Operational difficulties of evaluating the applicant need to be considered. This study suggests that, in order to support the need, social legislation be consistent with the actual living conditions and supplementary measures be designed.
