鄉鎮市調解制度乃是最貼近百姓日常生活中,解決糾紛快速、經濟的機制,因此,對於社會和諧、疏減訟源是極其必要存在的制度。 本研究立基於常民化定位的鄉鎮市調解制度,以此思考鄉鎮市調解有別於其他專業調解差異性之定向。 研究途徑分為靜態面與動態面,經由靜態之制度研究,其主要依文獻分析、統計資料及條例沿革等等做為基礎論述,就現行制度設計逐一探討,做為觀察制度發展的基礎,藉由全面性探討鄉鎮市調解制度,進而提問。 本研究在動態實證上採取半結構式方法,進行深度訪談。訪談對象為實務運作中五種不同角色(調解委員、調解委員會秘書、接受調解人、法官、警政人員(單位)),以多元、全面來檢證鄉鎮市調解制度。試圖透過靜態分析與動態實證的結合,提出制度設計上的建言及強化鄉鎮市調解功能的做法等,希冀建置更健全、信賴的制度,以利社會、司法資源節約的結論及建議。
The Township Mediation System is a system very much close to the everyday life in Taiwan. It is designed to avoid and reduce the lawsuits, resolve disputes efficiently, and save social resources. Therefore, the System is extremely essential for social harmony. This study argues, the ordinary people’s mediation system, based on popularization of legislation, is different from other professional mediations. The research approach is divided into two categories: the static and the dynamic. The static method of the System, according to literature review, calls for document analyses, statistics, and regulations to draw upon discussions on the cases of current system design, the development of observation system, and a comprehensive study of the township mediation system, in order to pose further questions on the System itself. This study takes the dynamic empirical method of semi-structured by in-depth interviews with five different subjects in practice (including Mediation Committee Members, the Secretary of the Conciliation Commission, mediation parties, judges, police officers or unit). By a multiple comprehensive review, mediations in township are there permitted. The static analysis proves that the dynamic empirical method poses to indicate and propose the design of the System, which serves the mediation functions and strengthens the township practices. This study aims to suggest a healthier and more reliable mediation system, judicial findings, and recommendations in resource conservation for the townships in Taiwan.
