公寓大廈管理條例與民法物權分管契約關係之研究

摘要


公寓大廈,學說上稱為「區分所有建築物」,其問題可分兩大方面:所有關係與管理關係。其中,所有關係為管理關係之基礎,而所有關係又可分成三大部分:專有部分、共用部分及其基地。專有部分為區分所有建築物之核心,共用部分則交織其中,形成錯綜複雜之區分所有,因共用部分有稱共同部分、共有部分,本文為統一用語而以共用部分稱之。是以,區分所有建築物複雜異常,有別於傳統之物權客體,則本論文即以此為研究對象,冀由最根本之課題著手,專注於專有部分及共同部分之研究,而將論文題目定為「公寓大廈管理條例與民法物權分管契約關係之研究」,裨利公寓大廈管理條例之正確認識與應用,使相鄰住戶間之權利義務,適得其所,進而創造植基於公平正義之祥和社會。 本研究並以參酌外國立法例及我國立修法沿革,作為引文,並另行整理國內外學者文獻加以討論,希冀藉此達到區分所有制度之完整。 區分所有權創設之內容,學說上分別有最狹義說、狹義說、廣義說及最廣義說,然不論採取何說對於區分所有人團體之權利義務或管理事務之進行均無影響,因專有部分之所有人,亦必擁有共用部分及基地之應有部分持分權,而依二部分之所有權,區分所有人互相間自成一團體,所有人自得以其成員來行使權利。民國99年5月26日之物權所有權通則之修法,並使我國區分所有制度及分管契約更趨明確。

Apartment building, the doctrine known as "distinguish between all buildings", the problem can be divided into two main areas: all the relationships and manage relationships.
