專利技術之特定市場界定-以瀏覽器發展為例

摘要


特定市場界定在競爭法判斷上,屬於基礎性議題,在判斷特定事業之市場力量,必需先界定特定市場。現有競爭法特定市場界定之概念發展,是從傳統實體市場結構出發,其概念強調供給與需求所產生的市場結構。但隨著科技發展,產品市場上開始出現非實體的商品與無供給限制的虛擬商品。而在地理市場上,隨著網際網路的出現,過去存在區域性的分隔界線已完全被打破,傳統垂直交易的市場結構,也轉變為無界線的水平交易。因此本文分析傳統的特定市場界定方法後,以瀏覽器為例,分析使用傳統特定市場界定方法在專利技術下可能產生的障礙。例如隨著觸控上網裝置的發展,瀏覽器也不再像過去僅在個人電腦上使用,因此其特定市場範圍的界定,隨著變因的增加,包括瀏覽介面不同、操控方式不同等,傳統用可替代性來判斷產品市場範圍的方法其困難度將大為提昇。本文亦將分析瀏覽器之特性,嘗試找出更適合的特定市場界定要件。並嘗試提供專利技術在進行特定市場界定時可以修正的方向。

The article take the internet browser for instance. Make it clear of the patent; function and relevant market relationships. And how to use tradition relevant market define theory, the reasonable interchangeability, to define the patent technology market.
