摘要

國內非營利組織的蓬勃發展已形成與公部門和私部門鼎足而立的第三部門，但卻因缺乏合理成熟的規範而每每陷於經營的困境。基於非營利組織所扮演角色之重要性與日俱增，公衆爲确保個人對非營利組織的損贈能被善管理運用而不致浪費，開始出現檢討既有的非營利組織監督機制之聲浪，希望能建立更完善的監督機制。本文從非營利組織所體現的公民社會系絡，來探討非營利組織與政府之間的關係，並由較「監督」一辭更廣義、開闊的「課責」(accountability)概念來探討非營利組織（特別是財團法人）監督機制的相關問題，並以之檢視我國非營利組織監督機制的現況。

These years Taiwan's NPOs has expanded and diversified. The NPOs in Taiwan are regulated by the Civil Code. In addition to the Civil Coed, there are other laws that encourage and regulate the establishment of NPOs. These laws are discrepant and antiquated. If we want to improve the development of NPOs and to establish the strong civil society, we must enhance and rationalize the mechanism of supervision for NPOs. We investigated the relation between state and NPOs, and used the concept of ”accountability” to explore related issues.
