國家主權與主權國家的迷思－人道軍事干預、經貿全球化與主權理論的反思

摘要

冷戰結束後，隨著人道軍事干預與新的經濟全球化浪潮的蓬勃發展，如何重新認識和掌握國家主權理論與實踐的變化和發展，成為政治學者和國際關係研究者掌握國家發展、調整國際戰略的重要焦點。於是，國家主權理論的研究重新興起，針對新的國際關係實務而反思傳統理論。
「主權」(sovereignty)一詞是一個發展中的概念，其內涵和外延不斷地得到充實，它是特定的歷史、社會和經濟條件的產物。在當前人道軍事干預與經貿全球化的背景下，主權面臨的問題和挑戰更是不同於以往。為此，實有需要重新檢視國際關係的主權理論，以理解國家主權原則的演變，以及反思其理論和實務的價值。本文嘗試從《聯合國憲章》的國家主權觀點著手探索當代（西方）國家主權概念的緣起與主權原則的國際規範意涵，進而探討人道軍事干預與經貿全球化對國家主權原則的挑戰，以及藉由當前國際關係理論觀點反思國家主權理論，最後指出學者應該重新思考國家主權原則（理論）的意義，而能提出新的理論思維與實務參考。

After the end of the Cold War, along with the abundant development of the humanitarian military interventions and new economic globalization, it is a very important focus to re-know and re-grasp the change and development of the state sovereignty's theories and practices for the political scientists and international relations researchers in grasping the national developments and adopting international strategies. Therefore, the return of the sovereignty theory studies focus on the new practices in the international relations and the reflections on traditional theories.
Sovereignty is a developing concept; it is a product of particular historical, social and economic conditions, its implications and extensions continually get refreshed and refilled. Under the background of the contemporary humanitarian military interventions and economic globalization, the problems and challenges that state sovereignty faced have been dissimilar than before. In this case, it is necessary to review the sovereignty theories for understanding the evolution of the sovereignty principles and reflecting their values in theory and practice. This article attempts to use the UN Charts to explore the original of the contemporary Western states sovereignty and the international normal implications of the sovereignty principles, and to discuss the challenges that humanitarian military intervention and economic globalization induced on the state sovereignty principles, furthermore, to reflect on state sovereignty theories with the international relation theories, finally to ask the researchers to rethink the meanings of the state sovereignty theories and to summit new theoretical perspectives and guidelines for practices.
