摘要

性侵害是暴力犯罪中最令人驚恐的犯行之一，少年性侵犯者很值得投入專業資源加以矯正處遇，因為他們的可塑性及改變的潛能較高，且少年若未得到適當的處遇（身心治療或輔導教育），則他們日後成為成人犯及停留在刑事司法體系中的可能性相對較高。少年性侵犯者之身心病態之程度或許不若成年性罪犯，但是近幾年也常見男女少年因為人際間之輕微糾紛或彼此過節，而以嚴重的集體性侵無辜少女作為報復或教訓的手段，可見少年性侵犯行一樣對於社會造成嚴重的傷害。本文作者以參與觀察法對少年性侵犯者進行分析，並聚焦於以相關學理分析少年性侵犯行之成因，並以作者兼具學術研究及實務服務的背景經驗，提出對於性侵犯行少年之評估、輔導教育及身心治療之策略與作法，並強調少年性侵犯與成人性侵犯並不盡相同的特徵，作為提升少年性侵犯矯正處過的重要思考。

Sexual offending is one of the most horrible crime. Compared with adult offender, juvenile sex offenders are more worthy of professional treatment, because that adolescents are more likely to be cured or changed. If juvenile offenders could not receive appropriate intervention and treatment, they might stay within criminal justice system for longer period of time or even become adult offenders. From pathological point of view, juvenile sex offenders may be not as worse as adult offender. However, when we looked into many serious cases committed by juvenile offenders who had just been slightly ridiculed by their peer, we were very surprised that they had been so cruel to their victims as to rape them as a revenge to minor conflicts. It is apparent that sexual crimes committed by adolescents are as worse as those committed by adults.
The primary purpose of this article is to analyze juvenile sex offending by using participant observation method, especially focusing on analyzing causal factors that are theoretically driven. As a scholar with practical experience in treating sexual offenders, the author proposes useful strategies and measures for better assessing and treating juvenile sex offenders. The author stresses that some differences from adult offenders should be noted when treating juvenile sex offenders. These discussions definitely could be very important to those who are prepared themselves to become an expert for assessing and treating juvenile sex offenders.
