中醫艾灸治療受憲法法律保障

摘要

艾灸療法為傅統中醫療法重要之一環，以其能回垂絕之元陽、透諸經而除百病而為數千年來歷代醫家用以作為民族保健之良方。然而近來少數醫者卻以其煙燻味會造成患者不適並且違反勞工安全衛生法規定為由，於媒體上大加撻伐，視艾灸如草芥、棄艾灸之療效如蔽屣。
本文從艾灸傳統療效、我國憲法、大法官會議解釋以及相關法律論點為基準，加以探討評析少數醫者所持法律觀點之謬誤，並彰顯艾灸治療完全受我國憲法法律保障之原由。

Moxa-moxibustion is one of the important therapy in the Traditional Chinese Medicine, Which can rescue the major yang qi, Unblock all meridians and treat all illness, and has already used for thousands of years for the doctor of the Traditional Chinese Medicine. However recently few doctor consider that moxa smokes can cause patient improper and violate the Safely-Sanitary Labor Law and they Give up such effective treatment and Lash it out on the media.
This paper is base on the moxa-moxibustion effect, the constitutional law, the interpretation of great judge meeting and related legal question. It discussed the misunderstanding to the mosamoxibustion for common people and revealed the original of constitutional law guarantee of mosamoxibustion.
