論國家通訊傳播委員會作成之行政處分的訴願決定機關

The Analysis of petition Instituitions of National Communications Commissions which Made Administrative Action

摘要


依據行政訴訟法第4條第1項的規定:「人民因中央或地方機關之違法行政處分,認為損害其權利或法律上之利益,經依訴願法提起訴願而不服其決定,或提起訴願逾三個月不為決定,或延長訴願決定期間逾二個月不為決定者,得向高等行政法院提起撤銷訴訟」。顯然,訴願程序乃是行政訴訟的先行程序。該程序提供了行政機關內部自我控制的機會。但訴願法制定之時並未顧及獨立機關的問題,如果獨立機關所作成之行政處分,須經訴願程序始能進入行政訴訟程序,則存在上級機關干涉獨立機關決定之可能。國家通訊傳播委員會的成立乃是為了回應言論自由的要求,是故,該會是以所謂的獨立機關或獨立行政機關之組織形式加以設置,該會必須依據法律獨立行使職權。因此,在法律文意明確規定下,勢必僅能透過修法方式使其取得更大的決定空間。

Under Article 4 section 1 of Administrative litigation act, administrative appeal is preliminary procedure of an administrative litigation. Such procedure provides inside examination of an agency's decision. However, when Administrative Appeal Act enacted, the legislature did not consider issues relating to independent agencies. If an independent agency's decisions are required to be reviewed under administrative appeal before initiating an administrative litigation, the independency of such agencies could be diminished. For protection of freedom of speech, the government established the National Communication Committee (NCC), and designated it as an independent agency. Therefore, NCC should exercise its power without interference of other agencies. Nevertheless, because of the clear language of Article 4 of the Administrative Procedure, NCC faces hardship to maintain its independent status. Consequently, the statute should be amended in order to provide more deference and independence to NCC.
