法律與宗教的互涉詮釋:《淮南子》的法律思想

摘要


西方法理學家伯爾曼在《法律與宗教》一書中指出:法律的內在精神是正義,民主多數決無法證成法律的正當性,一定程度上,必須藉助宗教的神聖性。因此,本文援用西方「神學自然法」的理論,闡析《淮南子》的法律思想。相關的議題有:法律之起源除了「發於人間」、「生於眾適」以外,尚有「法生於道」、「道源於天」的超越性的、宗教性的終極依據。所以,法律固當因應時局之變而有所因革損益,但在變易的事物之上,仍應堅守普遍性的、恆常性的、帶有宗教性質的「天道」。而《淮南子》除了強調法律乃「人主之準繩」以外,更以神聖性的「天」,作為人間君主施政立法之指導原則,其意不在將專制政體合理化。反之,是以宗教精神提升人間政治。
