Abstracts

〈二年律令〉十九條律文中所見「隸臣妾」，均為漢律徒刑刑名；〈奏讞書〉中與「隸臣妾」相關之四個案例的情況是：案例14所見「隸臣」、「隸臣妾」，為西漢初漢律徒刑刑名；案例20、21所見「隸臣妾」，可確定為秦律徒刑刑名；案例22所見「僕隸臣」可以確定為秦刑徒，而「隸妾」則不能確定其身份。上承秦制而來的「隸臣妾」之制，發展到漢初已成為漢律徒刑刑名。

Parallel abstracts

The ”Li Chen Qie” (”Servitude penalty”) seen in the Er Nian Lu Ling is the imprisonment charge of the Han-lü. In Zou Yan Shu, there are four cases connected with ”Li Chen Qie”: The ”Li Chen” or ”Li Chen Qie” appeared in Case 14 are the imprisonment charge of Han-Lü in the beginning of Western Han Dynasty. The ”Li Chen Qie” shown both in Case 19 and in Case 21 is indeed the imprisonment charge of Qin-Lü. ”Pu Chen Qie” appeared in Case 22 is the imprisonment charge of Qin-Lü. However, we can not verify the identity of the ”Li Qie”. The ”Li Chen Qie” was followed the system of the Qin Dynasty. It became the imprisonment charge appeared in Han-Lü in the beginning of Western Han Dynasty.
