論特別休假制度:勞動基準法新、舊規定之比較-以護理人員勞資糾紛判決為例

摘要


勞基法第38條關於勞工特別休假制度之規定,於105年12月與107年1月進行幅度不小之修法,此修法結果對勞工之特別休假權益產生重大影響。本文擬說明勞基法第38條關於特別休假制度之新規定,並介紹一則護理人員所涉及之勞資糾紛判決,協助護理人員由實際案例了解特別休假之相關權益。

The regulations regarding annual paid leaves regulated by Article 38 of the Labor Standards Act was amended on December, 2016, and January, 2018. This article introduces the new regulations regarding annual paid leaves regulated by Article 38 of the Labor Standards Act. In addition, this paper also introduces one judicial judgment related to an employer-laborer dispute involving a nurse. It is hoped that nurses may gain a better understanding of their rights regarding annual paid leaves from this judicial judgment.
