摘要

眾所承認者，傷害保險為人身保險中爭議性最高之險種之一。其涉及之爭議主要集中在「意外傷害事故之認定」及「舉證責任之分配」。本文即針對此二爭議議題，詳細歸納分析學說觀點與法院見解，並提出本文之看法，用供各界參考。
