從社會促進制度談教育權之給付作用

Discussing the Payments of Educational Right from the Sozialförderung

摘要


我國近年來昂貴的學費成爲家庭負擔,甚至阻礙人民憲法上教育權之發展。本文主要在介紹社會促進制度中之教育促進,希望能增強教育權之給付作用,藉以落實憲法相關保障。文章首先分析教育權之憲法保障基礎,並探究社會促進制度之憲法依據。其後介紹德國教育促進制度之發展,並嘗試建構與分析我國近年相關措施。文末並提出些許心得與建議。

In recent years, Taiwan's expensive tuition becomes the burden of family, even obstructs the development of people's right of education from Constitution. This paper describes the German Social Law's Sozialförderung, and related measures of Ausbildunsförderung among the Sozialförderung, hopes to add the Payments of Educational Right, so as to practice the relevant safeguard of Constitution. This article analyses the safeguard basis of Educational Right from Constitution above all, and investigates the constitutional foundation of Sozialförderung. After, this article introduces the development of the German Ausbildunsförderung system, and tries to set up、analyze Taiwan's related measures in recent years. At last, this article will raise some study and suggestions.
