我國法人分類制度之探討

摘要

法人制度之種類繁多，其功能亦因種類不同而有所異，依據法律規範現行法人計有區分公法人及私法人，在公法人領域中又區分為公法人與行政法人，而私法人中則區分社團法人與財團法人，本文則是從法人屬性開始探討，如何區分公私法人、如何區分財團與社團法人間之差異，並探討中間法人之定性，最後對於現行民法之法人分類提出修法建議，以圓滿法律規範之意旨。

There are many kinds of Juridical Persons, such as Juridical Persons、Non-departmental public bodies、Public bodies、General Provisions、Corporations etc. And it is true that the different Juridical Persons has different function in law. Therefore this paper attempts to clarify the contractual relationship Juridical Persons. This paper proposes suggestions on Juridical Persons on amending the existing law as a response to the debate of Juridical Persons legal remedies.
