網路違法攻擊性言論之總體趨勢及校園案例分析
The Analysis of General Trend and Campus Case Study of Illegal Internet Offensive Speech
摘要
本研究一方面將先就歷年來網路違法攻擊性言論之總體趨勢進行分析，包括恐嚇、毀謗、公然侮辱三類型；另一方面就大學校園網路涉及公然侮辱言論之12則民事判決進行分析，盼能有助於大學生乃至於各級學校教師對於網路言論自由之界線形成較正確之認知，並了解違反、逾越此一界限所應承擔之責任。研究發現民國89年至98年合計10年以來地方法院因網路恐嚇、毀謗、公然侮辱所引發之民、刑事判決趨勢，顯現出此等因網路上攻擊性、冒犯性之言論引發司法糾紛的情形明顯呈上升走勢，特別是在近三年來顯現出陡升的情形，的確是大學教育必須即刻予以重視的環節。此外，就大學校園網路涉及公然侮辱言論之12則民事判決進行分析後發現，所有判決法院均認定被告涉嫌公然侮辱之言論構成對原告名譽權之侵害，並分別判決被告應給付原告新台幣5千元至50萬元不等之精神賠償，法院於判斷網路留言者對於他人名譽權之侵害是否有「故意或過失」或「真實惡意」，以及於核算精神賠償之際，對於大學生乃至於教師等知識份子，往往亦有言行及認知應與個人學歷相當之期待，從而本研究亦建議教師亦應謹守網路言論之分際，並於教學上向學生多所倡導，共同培植及樹立正向的網路公民社會。

This article will analyze the the general trends and 12 civil judgments about illegal Internet offensive speech from campus over the years including intimidation, defamation, an affront. Our hope is helping college students and even all levels of teachers forming knowledge of the boundaries of free speech for the network and correct perception and understanding of the responsibility as violating the limit. Study found that civil and the number of District Court criminal judgments illegal about Internet offensive speech showed Clear upward trend from 2000 to 2009. A spiking upward appeared especially in the last three years. University education indeed should pay attention to it immediately. In addition, after analyzing 12 civil judgments about illegal Internet offensive speech from campus, we found that all the verdicts identified defendants against the right of reputation of plaintiffs and sentence the defendants should pay the mental compensation to plaintiffs from NT 5000 to 500,000. From these verdicts we also found the judges showed their expectations of the equivalent behavior to college students and teachers as determining whether the violations for the reputation of others was ”intentional or negligent” or ”real malice”. So we also suggests that teachers should keep the distinction of network speech and advocate correct speech boundary to students to jointly cultivate and foster a positive civil society of network.
