應用犯罪偵查知識工程化於刑案偵查實務之探討—以八里雙屍命案為例

摘要

自2013年2月26日發現被害人陳○福屍體，直到目前最高法院撤銷死刑判決發回高等法院更審，尚待釐清被告所強盜之財物等證據；在社會大眾將焦點關注在被告是否判處死刑之際，身為執法人員第一線的警察，更應審慎地檢視本案件之偵辦過程，從發現被害人屍體時研判疑似自殺或他殺，甚至到後來的強盜殺人之偵辦過程，逐一檢視及檢討案件偵查手法、技巧及程序之優劣，並符合犯罪偵查知識工程化，作為後續偵查人員辦案之參考及運用。因此本文試以犯罪偵查知識工程化之方式，建立「合理化」、「科學化」、「系統化」、「規則化」之犯罪偵查基本原則。

Since February 26, 2013 discovered the bodies of victims. The Supreme Court reversed the case back to the High Court. When the public will focus on whether the accused is sentenced to death, police officers should carefully review the investigation process of the case. Fromthevictims' body was found, and the later investigation process, review the investigation tactics, techniques and procedures. And apply for ＂rationalization＂, ＂scientific method＂, systematization ＂Regularization＂ to criminal investigation of engineering knowledge.
