供人食用牛來源明膠及膠原蛋白之國際輸入法規探討
Discussion of Regulations on Importation of Gelatin and Collagen Derived from Bovines and Intended for Human Consumption
摘要
食用具牛海綿狀腦病感染力的牛組織或相關產品可能導致罹患人類新型庫賈氏症之風險，許多國家政府考量牛肉及其產品之安全性，為降低消費者健康風險，而採行管制措施。本研究主要針對國際間對牛來源明膠及膠原蛋白之輸入管理措施進行探討，世界動物衛生組織、美國、紐西蘭、日本(草案修正後)及韓國等多採取不限制牛皮源性明膠或膠原蛋白及其原料之輸入，歐盟則要求由第三國輸入產品須檢附衛生證明；對輸入牛骨源性明膠或膠原蛋白及其原料之限制則較皮源性明膠嚴格，採取禁止輸入或限制輸入，限制輸入為依據世界動物衛生組織對牛海綿狀腦病之風險狀態，分級檢附適當衛生證明，顯示牛骨源性類產品供人類食用仍被認為具健康風險。因此建議我國可開放皮源性明膠或膠原蛋白及其原料之輸入，而骨源性明膠或膠原蛋白及其原料之輸入則維持限制輸入之管理，以確保輸入產品之安全性。

The emergence of new variant Creutzfeldt-Jakob disease (nvCJD) is considered likely that human consume bovine tissues or products with bovine spongiform encephalopathy (BSE) infectivity. Because of the safety concerns from gelatin and collagen derived from bovines, many countries adopt and enforce importation measures in order to minimize BSE-risk on trade. The purpose of this study is to discuss of regulations on importation of gelatin and collagen derived from bovines. After comparison with Office International des Epizooties (OIE), European Union (EU), United States (US), New Zealand, Japan, and Korea measures on importation of gelatin/collagen and raw materials derived from bovine hides and skins, OIE, US, New Zealand, Japan (when the draft amended), and Korea allow gelatin/collagen and raw materials to be traded without BSE restrictions, regardless of the exporting countries’ BSE-risk status. EU requires that products from the third countries must be accompanied by health certificates of the exporting country; on the other hand, many countries adopt strict BSE restrictions on gelatin/collagen and raw materials derived from bones, such as prohibited or restricted importation. Restricted importation means products shall be accompanied by health certificates according to the exporting countries’ BSE-risk status, and indicates that importation of gelatin and collagen derived from bones intended for human consumption still pose BSE-risk. Therefore, the revised BSE measures for Taiwan may allow gelatin/ collagen and raw materials derived from hides and skins to be traded freely and without BSE restrictions, and remain prohibited importation or adopt restricted importation of gelatin/collagen and raw materials derived from bones to ensure importation safety.
