我國輸入食品查驗法規與WTO貿易便捷化協定合致性研析

Research on the Consistency between Taiwan's Imported Food Inspection Regulations and WTO Trade Facilitation Agreement

摘要


貿易便捷化為實踐貿易自由重要環節,亦為近年國際上雙邊自由貿易協定或多邊之區域經濟整合協定之必備篇章,要求簽署國應高度落實貿易便捷化。各國在邊境所採取之食品安全衛生查驗,影響貿易貨品通關時效,查驗措施與作業實屬貿易便捷化議題範疇。臺灣為世界貿易組織會員並已完成貿易便捷化協定簽署及國內批准程序,貿易便捷化協定成為食品輸入查驗應依循法規,查驗機關執行查驗應符合該協定規定。經比對與分析,現行臺灣輸入食品查驗相關法規與貿易便捷化協定所定之原則相符,執行面上亦基本具合致性。

Trade facilitation is an important sector in the practice of trade freedom, and it is also an inevitable chapter of international bilateral free trade agreements and multilateral regional economic integration agreements in recent years, requiring signatory countries to implement trade facilitation to a high degree. The inspection on food safety and hygiene of food imports at border affects the efficiency of customs clearance of traded goods. The inspection measures and operations are indeed within the scope of trade facilitation issues. Taiwan, a member of World Trade Organization (WTO), signed the Trade Facilitation Agreement (TFA) and completed the ratification process. The TFA regulations should be followed and conducted by the Taiwan inspection authorities as Taiwan is one of the TFA members. The analysis results of consistency dressed current imported food inspection regulations of Taiwan were in line with the principles set by the TFA, and were basically consistent with the TFA in terms of implementations.
