公堂面面觀︰論「公案」空間之文化意義
The Courtroom Aspects: On Cultural Significance of the "Koan" Space
摘要
公案發生地點，具體而言，就是公堂，公堂是判官執行職權、審問犯人、判決案情之所在，也就是刑訊最常發生的地點，甚至有可能因下手太狠使公堂成為犯人喪命的刑場。中國歷來探討小說最常著眼的是時間的歷程，卻鮮少從空間的角度探索，因此近年來，不同領域的學者包括歷史、人類、哲學和文化批評家等，紛紛對空間觀念提出新的詮釋方式，激起跨學科的思辨漣漪，有形的公堂固然以陽間最為常見，在地獄故事或志怪筆記裡，幽冥界也有公堂，且受到佛教因果輪迴思想的影響，幽冥界公堂裡上演的酷刑比陽世更慘烈，具有警世的效應。從社會與文化的角度而言，公堂空間和歷史的演進息息相關，公堂更是一種政權賦予影響力的力場，執行權力的場域。本文試圖從有形的公堂的空間形式著手，從人間乃至冥界的不同角度，冥界可區分文字和圖像兩類；繼之分析公堂的抽象意識，從社會文化結構、權力象徵與敘事空間來探討，讓公堂這個看似單純的判案空間，有了豐富而多元的文化意義。
