印尼看護工就業歧視之研究-以國族主義為中心

摘要


受全球化影響,自1980年代開始臺灣引進第一批合法移工,而臺灣採用與德國相同的「客工」制度,在受全球資本主義深化後的臺灣從所謂的邊陲國家引進相對廉價的勞動力,在此歷史脈絡下已經過了四十餘年,談國族主義與種族等相關議題已在前人不懈的努力下有豐碩成果,然而在國族與階級的面向來看卻依然根深蒂固在多數人的心中,具有貶意性的代名詞、階級的差別待遇仍舊無法抹去,並且這將演變成長期的就業歧視與種族歧視。本文旨在討論臺灣因國族與階級主義受到就業歧視之移工的相關權利與保障,並以國族主義之相關文獻與就業歧視之勞動關係面向方式進行探索。藉此建構出臺灣移工的勞權圖像與脈絡。最後,亦提出具體政策主張,以國族主義為中心論證「移工就業歧視」之成因與現況,並探討在現行行政與立法上是否在制訂時納進相關國族政治與階級的考量,希望能夠斷根枯葉的方法解決外籍移工就業歧視問題,其中包括逐步走向移民政策,透過檢視政策與法規的方法,第一可提升移工權益,再者則消除國族階級與隔閡、歧視。

Due to globalization, Taiwan began to introduce the first batch of legal migrant workers in the 1980s. Taiwan adopted a similar "guest worker" system as Germany, importing relatively cheap labor from so-called peripheral countries in the context of deepening global capitalism. Over forty years have passed in this historical context, during which discussions on nationalism and race have yielded fruitful results through the relentless efforts of predecessors. However, from the perspectives of nationality and class, derogatory terms and differential treatment based on class still persist in the minds of the people. This has evolved into long-term employment discrimination and racial prejudice. This article aims to discuss the relevant rights and protections of migrant workers in Taiwan who face employment discrimination due to nationalism and classism. It explores these issues through the lens of relevant literature on nationalism and labor relations. Through this exploration, it seeks to construct an image and context of labor rights for migrant workers in Taiwan. Finally, concrete policy proposals are put forward, focusing on nationalism to argue the causes and current situation of "employment discrimination against migrant workers". It also examines whether relevant considerations of national politics and class are taken into account in Taiwan's administrative and legislative processes. The hope is to address the issue of employment discrimination against foreign workers at its root, including gradually moving towards immigration policies. This can be achieved by examining policies and regulations to enhance the rights of migrant workers and eliminate national and class barriers and discrimination.
