從海洋空間規劃（MSP）看海洋垂釣活動
Exploring Sea Fishing Activities from Marine Spatial Planning (MSP)
摘要
台灣自2019年3月20日起，即以「積極開放，有效管理」著手盤點目前漁港及商港適合開放釣魚之場域，同時陸續展開各項協商與對話。2020年起，海洋委員會海洋保育署草擬並公布臺灣友善釣魚行動方案，以友善環境之垂釣原則為基礎，逐步落實建置臺灣友善釣魚環境。根據資料推估，台灣號稱約計有高達230萬名釣友，追上國際已開發國家的人口10%的占比水準。現有討論海洋垂釣之開放場域，已開放92處釣點包括有漁港、商港與國家公園等，唯該如何處理海洋空間規劃（Marine Spatial Planning, MSP）上的衝突，釐清與解決其間相關問題點，並尋求整合以及共生共榮的可能性，方得以創造雙贏，甚且是多贏的局面，實值得探討。本文首先從相關主管機關以及法令規範進行分析，結果發現，現行海洋垂釣活動主要涉及行政院交通部、行政院內政部及行政院農業委員會等部會。為因應日漸增加的垂釣人口，政府部門也積極推動各項便民措施，而政府單位支持的各項行政作為，著實有效推動了社會整體對於垂釣活動的重視與支持。然由幾次抗爭事件，也可以發現現今仍存在部分的爭議與問題待決。因此，本文以海洋空間規劃角度，嘗試理解與分析法規與制度、港區開放與管理與搭船海釣機會點與問題點，並據之以提出結語。

Since March 20, 2019, Taiwan has started to research its current fishing ports and commercial ports suitable for fishing based on the principle of ＂active opening up and effective management＂. At the same time, various consultations and dialogues have been carried out one after another. Starting from 2020, the Ocean Conservation Administration has drafted and announced a friendly fishing action plan in Taiwan. Based on the fishing principles of a friendly environment, it targets to gradually implement and build a friendly fishing environment in Taiwan. According to estimates, there are about 2.3 million people who enjoy fishing in Taiwan, which denotes a fishing population of 10% that many developed countries in the world also have. At present, 91 fishing spots have been launched in open areas for ocean fishing, including fishing ports, commercial ports, and national parks. However, how to deal with conflicts in Marine Spatial Planning (MSP), clarify and solve the problems, and seek integration, co-existence, and co-prosperity to create a win-win situation and even all-win situation are issues worth exploring. First, from the analysis of relevant authorities and laws and regulations, this study found that the current marine fishing activities mainly involve the Ministry of Transportation and Communications, Ministry of the Interior, and Council of Agriculture, Executive Yuan, and other departments. In order to cope with the increasing fishing population, government departments have also actively promoted various measures that are convenient to the public. The various administrative actions supported by government units can indeed effectively promote the attention and support of the society as a whole toward fishing activities. However, as seen through several protests, we also find that there are still some disputes as well as problems that need to be resolved. Therefore, from the perspective of Marine Spatial Planning (MSP), this study aims to understand and analyze the problems of related laws and regulations, the opening and management of port areas, as well as sea fishing by boats and puts forward conclusions accordingly.
