我國警察裝備導入拋射式電擊器之探討

摘要

拋射式電擊器是面對有暴力威脅情況下可行的警械選擇，國內自2016年已配發一些作為執勤使用，至今尚未有使用案例發生；當前內政部警政署與相關警察機關聚焦在執勤效益積極爭取該裝備數量外，亦有必要一併考量其他配套機制。本文先針對導入拋射式電擊器的政策背景進行回顧，另參考國外警察使用經驗與優缺點，探討其所涉及國內相關法制層面，最後對於使用拋射電擊器「前」、「中」、「後」三個不同階段可能面臨之挑戰，提出因應的建議，以期符合員警實際執勤所需。

Electric stun guns are a practicable option for police officers facing violent situations, and some have been equipped for duty use since 2016 in Taiwan. Until now, there is no one armed with stun guns used force. However, when the National Police Agency and the relevant police departments focus on the effectiveness and fight for budget to increase the number of devices, it is necessary to design the supporting mechanism. This study reviews the policy background of the introduction of stun guns. Referring to the advantages and disadvantages by foreign police's using experience. And discusses the relevant domestic legal aspects involved. Finally, the three different stages of the use of stun guns ＂before, now and after＂ may face challenges, and corresponding suggestions to meet the actual operational requirements of the police.
