人權法和智慧財產權法曾經被認為是不相干的學門,然現在其間之緊密關聯性已經逐漸引起注意,過去十年來,這兩個法學門各自發展,但最近國際間已開始為兩者先前未知的交叉點進行探索。在我國,智慧財產權法的研究向來從民事法學的觀點進行,即可能出現若干盲點,因此,本文擬從智慧財產權與人權間其互動關係、發展脈絡、出現之爭議、以人權的途徑來保護智慧財產權、智慧財產權下關於人權的框架、平衡之道等面向進行觀察,並進而就人權與智慧財產個別權利(限於專利、著作權、商標)之交會做初步探索,希望讓上開二者間之互動有較為清晰之輪廓,並對智慧財產權法與人權法之聯結有所裨益。
Human rights and intellectual property rights used to develop in different tracks. However, over the past decades, the law society has started to pay unprecedented attention to the possibility of their intersection. In Taiwan, studies of intellectual property rights are often conducted in the respect of civil law body, which is likely to raise blind spots thereof. Regarding this, the researcher attempts to review the historical development of human rights and intellectual property rights, to analyze related documents from home and abroad, and to inquire into their mutual interaction, in combination of exploring the compatibility of human rights and patent, copyright and trademark, so as to gain a primary understanding of the above issues.
