本研究目的在於探討分析販毒被告在面臨偵查時認罪與否的決定因素。本研究參與對象為臺灣桃園監獄、臺灣臺中監獄、臺灣臺中女子監獄、臺灣高雄監獄中315位販毒罪名受刑人,實驗方法為對渠等進行問卷調查以釐清販毒罪「量刑因子」對渠等販毒行為之影響。研究發現顯示,大部分販毒被告願意認罪的最重要因素是減刑條件。剝奪販毒利潤及確實執行死刑對於阻止販毒亦有巨大之嚇阻力,另外,對不同類型的販毒方式(例如攜帶武器販毒、在校園販毒、以電腦網路販賣毒品、販賣毒品次數)而給予不同之量刑標準,也會改變交易毒品的行為模式。根據研究發現,可以提供毒品法律有關販毒罪刑的修正法律方向及啟示。
The purpose of this study is to explore the determinants of drug trafficking accused pleading guilty in the face of investigation. The study participants were Taiwanese Taoyuan Prison, Taiwan Taichung Prison, Taiwan Taichung Women's Prison, Taiwan's Kaohsiung Prison, and 315 drug traffickers in Taiwan. The experimental method was to conduct a questionnaire survey on the canal to clarify the drug trafficking crimes and other drug trafficking behaviors and influences. The study found that the most important factor for most drug trafficking accused to plead guilty is the condition of commutation. Deprivation of drug trafficking profits and the actual execution of the death penalty are also a great deterrent to the prevention of drug trafficking. In addition, different types of drug trafficking methods (such as carrying weapons on drug trafficking, drug trafficking on campus, drug trafficking on computer networks, and drug trafficking frequency) are given differently. The standard of sentencing will also change the behavioral patterns of drug trafficking. According to the research findings, it is possible to provide the legal direction and enlightenment of the drug law regarding the crime of drug trafficking.
