網路販毒犯罪模式與防制對策之研究
A Research on the Crime Pattern of Internet Drug Trafficking and Countering Strategies
摘要
國內外罪犯利用網際網路進行販毒，使毒品的販賣與取得管道更迅速且便利，且COVID-19疫情爆發，在各國政府實施管制限制措施後，國內網路販毒勢必會有越來越增長之趨勢。研究結果發現，網路販毒集團組織結構系統化，網路販毒平臺有線上論壇、線上遊戲、社群軟體及網路通訊軟體等方式；交易毒品以安非他命、愷他命及新興毒品咖啡包居多；集團作案時間為全天、毒品交易地點通常以買家決定為主；集團成員採取單線聯絡、定期更換工作機、工作車輛、毒品倉庫藏放地點、面交過程全程開啟視訊等方式躲避檢警查緝。研究建議應盡速訂定科技偵查法，提升檢警科技偵查之查緝能量；由數位發展部盡速整合各部門，以有效管制網路、軟體、遊戲業者；訂定查緝網路販毒及獎勵計畫，強化警方偵查技術及加強化國際合作等面向，提出符合現況偵查及防制策略，期能作為實務界擬定政策之參考，以有效遏止網路販毒集團，保護民眾產生命財產安全。

The use of the internet in drug trafficking by domestic and foreign criminals has made the selling of, and access to, drugs ever faster and more convenient. To compound matters, after the control and restrictive measures adopted by various countries as a result of the eruption of the Covid-19 pandemic, domestic internet drug trafficking has definitely witnessed a growing trend. The results of this study indicate that internet drug trafficking syndicates are structured and systemized, with internet drug trafficking platforms featuring online forums, online games, community software, and Internet communication software. The traded drugs are mostly amphetamine, ketamine, and emerging drugs disguised in the form of coffee packets. The crimes may take place at any time of the day and at locations mainly determined by the buyers. To evade police tracking, the syndicate members adopt one-to-one only contact, and periodically change their work phones, work vehicles and the storage location of the drugs. They would also use video calling throughout the entire course of the face-to-face drug delivery as a form of surveillance by their bosses. It is recommended that 1) a scientific and technological investigation act should be formulated as soon as possible to enhance the capacity of scientific and technological investigation of the police; 2) the digital development department should integrate various divisions to effectively control the internet, software and game operators; and 3) an incentive scheme for internet drug trafficking seizure should be established to reinforce police's investigation skills and strengthen international collaboration. By proposing a strategy meeting the current investigation and prevention requirements, the study intends to serve as reference for the concerned authorities in policy drafting, with the hope of effectively curbing internet drug trafficking syndicates and to protect people's lives and property.
