當今社會中軍官的性別平權知能將成為任職後的重要職能,是故性別教育是軍校通識教育重要的一環。故本研究目的有三項:(一)透過文件分析,瞭解軍審法修法之後,在地方法院所承審之妨害性自主案件中,與軍方有關之判決書中所呈現的行為樣態、罪責類型等資料及比例;(二)探討現階段國軍院校通識教育基礎表中所列之科目,與案例分析中知識層面中若合符節之內容;(三)探討以議題融入課程方式,對通識教育課程進行教學的可行性。研究方法:以司法院判決書系統中,在2013年7月1日至2020年7月30日,於地方法院所判決的軍人所涉犯的妨害性自主罪的判決書,加以整理所發生的妨害性自主案件中,裁判法院、罪名類型、雙方關係、行為類型、發生地點、刑期長短、是否和解、是否獲得緩刑等各項進行量化的統計以及根據統計資料的描述。結果:針對文件內容所得結果,對目前官校的課程,除了原先的相關必修及選修課程外,建議加上文化與性別、性別與法律、性別與親密關係、性別、身體與科技、性別與職場等課程,以增進大學階段學生在情感教育以及法律方面的知能,以促成更佳的情感發展以及營造更好的人生。
The present research tries to point out the need of studying the gender education as an element of leadership formation of the future officers in the military academies. Using analysis approach, research purposes include: (1) Understand the nuisance autonomous cases tried by the local court after the revision of the military trial law, the behavior patterns and types of culpability presented in the military-related judgments. (2) Explore the subjects listed in the basic table of general education in CAFA at the current stage, if they match the content of the knowledge level in the case analysis. (3) Investigate the feasibility of integrating gender equality issues into the general education courses curriculum and feasibility of teaching. Research methods: via the Judgment System of the Judicial Court, verdicts from July 1^(st), 2013 to July 30^(th), 2020, are selected. They include the judgments of the crimes of obstructive autonomy committed by military personnel convicted by the local courts, sort out the cases of obstructive autonomy that occurred, the magistrate's court, the type of crime, the relationship between the parties, the type of behavior, the location, the length of the sentence, whether or not to reconcile, whether to obtain probation and other quantitative statistics and descriptions based on statistical data. Results: Regarding the content of the document, reviewing the current general education curriculum design of Republic of China Air Force Academy, in addition to the original general elective courses on gender equality and life, institute can consider adding culture and gender; gender and law; gender and intimacy; gender courses such as body and technology, gender and workplace, enhance the knowledge of emotional education and legal aspects of academy's students, so as to promote better emotional development and create a better life.
