摘要

本文討論對於未成年人性自主法益侵害的刑法管制模式，除了分析我國法既有規範結構的特點外，也將一併介紹德國法制目前的規範狀況，並透過德國刑法規範結構反省我國現行法制，同時提出若干未來修正的可能方向。

This article aims to explore the sexual offenses against juveniles and children. The main discussions focus on Taiwan's legislation. In addition, the author will introduce the Germany's regulation model. Through comparative studies on both models, the author tries to review Taiwan's provisions and suggest some possible way for future amendments.
