In the context of the COVID‐19, countries have taken different epidemic prevention measures. To some extent, these measures have restricted international trade and increased the situation of non‐self‐caused default. Hardship clause has always been an important part of international commercial law, which is an exception to pacta sunt servanda. And hardship clause plays an important role in balancing the interests of the parties to the contract. There are similar regulations and concepts in Principles of International Commercial Contracts, Convention on Contracts for the International Sale of Goods and ICC HARDSHIP CLAUSE.
