中國大陸農民工臨時夫妻法律問題研究

摘要
在中國大陸城鎮化的快速進程中，夫妻分居的農民工群體中出現了組建臨時夫妻以填補家庭生活空缺的現象。這不僅是一種社會的需求，也是對社會現實的一個反映和調整。道德、法律等社會規範已不能達到調整、規範的目的，其損害當事人的利益和社會的道德觀。從法律的角度評判臨時夫妻，不但涉嫌重婚罪，也侵害配偶權和破壞一夫一妻制度，而需要承擔相應的刑事責任和民事賠償責任。除了追究臨時夫妻法律責任來遏制違法犯罪行為發生，賦予農民工市民待遇才是消除臨時夫妻現象的治本之策。總之，如何對待農民工臨時夫妻現象是擺在法律面前的一個無法回避的社會問題。如何消除或減少農民工長久分居情況，減少臨時夫妻現象的發生，保護合法婚姻和家庭的正常發展，是解決農民工問題不可忽視的重要議題之一。

In the rapid process of urbanization in China, the phenomenon of establishing temporary couples to fill the gap in family life has emerged among migrant workers who live separately. This is not only a social demand, but also a reflection and adjustment of social reality. Social norms such as morality and law can no longer achieve the purpose of adjustment and standardization, and they damage the interests of the parties and the social morality. Temporary couples are not only involved in the crime of bigamy, but also violate the rights of spouses and destroy the monogamy system, and need to bear corresponding criminal responsibility and civil compensation liability. In addition to investigating the legal responsibility of temporary couples to curb the occurrence of illegal and criminal acts, giving migrant workers citizen treatment is the ultimate solution to eliminate the phenomenon of temporary couples. In a word, how to deal with the phenomenon of migrant workers' temporary husband and wife is an unavoidable social problem before the law. How to eliminate or reduce the long-term separation of migrant workers, reduce the occurrence of temporary couples, and protect the normal development of legal marriage and family is one of the important issues that can not be ignored to solve the problem of migrant workers.
