Technology Transfer in the International Seabed: Dilemmas, Experiences and Countermeasures
摘要
On the verge of commercial exploitation of the International Seabed Area (hereinafter ＂the Area＂), there has been a constant debate on the issue of technology transfer as it involves many interests. The inherent conflict arising from the existing technology transfer activities, which must comply with both the principle of the common heritage of mankind and the rules of commercial technology transfer, makes it difficult to advance technology transfer in the Area, leading to dilemmas in theory and practice. By building on the practical experience of successful technology transfer legislation in other international treaties, the International Seabed Authority can break through the dilemmas of technology transfer by strengthening the effectiveness of the commitment of the State Parties, constructing a technology transfer and capacity building fund and boosting international cooperation, in order to achieve the sharing of technological benefits of exploration and exploitation in the Area for all mankind.
