Reviwing Folk Religious Crimes in Taiwan: Focused on the Blissful Buddha Case
摘要
本文係對於2014年的歡喜佛案進行分析，探討其手法。首先，我國憲法保障宗教自由，在我國宗教自由政策下，社會上各類型宗教團體發展迅速，宗教信仰成為民眾追求物質之外的心靈寄託，但是「虔誠」與「迷信」常是一線之隔。「虔誠」可以讓人用理性探索教義，知道所信仰的是誰，「迷信」卻把理性扼殺了，變得盲從，不明瞭所拜為何。這也是許多有心人士常假借宗教之名，得以犯罪得逞的主要關鍵。台灣本土的歡喜佛案發生在2014年，由於此案涉及到宗教性犯罪，因此引起了社會上的高度關注。案由是行為人藉由宗教儀式和神秘力量誘騙信徒，從中牟取錢財，涉嫌妨害性自主罪和詐欺罪。法院在審理過程中，針對行為人的所謂「神聖儀式」和「神秘力量」進行了詳細的調查和證實，最終判決其犯有妨害性自主罪和詐欺罪，並處以有期徒刑。本文對此案進行評析，首先，在強制性交部分，本文指出學說見解為妨害性自主罪需要犯罪者有故意或針對性，而本案中此團體明知故犯卻仍繼續詐騙，其行為符合此罪名的定義。另外，本文也指出，在詐欺罪部分，學說之見解為需要詐騙者有故意與財產處分為目的，而本案中此團體對信徒的財產明知故犯，其行為亦符合此罪名的定義。本文之見解為，宗教性犯罪是一種高度危險的犯罪，因為它假借宗教之名，利用信徒對宗教的尊重與信任，進行詐騙和侵犯他人權益的行為。在保障宗教自由的同時，我們應謹慎防止迷信的侵害。因此，我們呼籲在法律和社會上加強對宗教性犯罪的打擊和防範，以保護公民的權益和維護社會的安定。

The Blissful Buddha case occurred in 2014 and attracted great attention in society because it involved religious crimes. The cause of the case was that the perpetrator lured believers lured believers into making money through "religious ceremonies" and "mystical powers", suspected of the crime of obstructing sexual autonomy and fraud. During the trial, the court conducted a detailed investigation and confirmation of the so-called "sacred rituals" and "mysterious forces" of the perpetrator, and finally found him guilty of obstructing sexual autonomy and fraud, and sentenced him to fixed-term imprisonment. This article reviews the case, firstly, in the section on forced sexual intercourse, this article points out that the doctrine that the crime of obstruction of sexual autonomy requires the perpetrator to have intentional or targeted sex, and that in this case, the group knowingly committed the crime but continued to deceive, and its behavior met the definition of this crime. In addition, this article also points out that in the section on fraud, the doctrine is that the purpose of the fraudster is required to intentionally dispose of the property, and the behavior of this group in this case is also in line with the definition of this crime. This article argues that religious crime is a highly dangerous crime because it uses the respect and trust of believers to deceive and violate the rights of others in the name of religion. While protecting religious freedom, we should be careful to prevent superstition. Therefore, we call for strengthening the crackdown and prevention of religious crimes in law and society in order to protect the rights and interests of citizens and safeguard the security and maintain social stability.
