Searching for the House of Taipei Bar Association in Memory: The Launch of Transitional Justice of Lawyers
摘要
台北律師公會的前身是1900年成立的台北辯護士會，1936年具有法人格後，未曾購置不動產作為會館，會員總會大多在高等法院會議室舉行。1934年台北法曹會成立，該會曾向台灣總督府申請無償使用高等法院舊廳舍基地十年（位於今台北市貴陽街與博愛路交叉口一帶），興蓋法曹俱樂部等建物。由於前述兩會人員多所重疊，台北辯護士會經常使用法曹俱樂部建物作為集會所。二次大戰後，原台北法曹會理事會於1945年11月22日決議將其所有的資產，包括該法曹俱樂部建物，移交台北律師公會；惟主導接收台灣司法機關的台灣高等法院，漠視該法曹俱樂部建物，從1934年以來作為朝野法曹聯誼場所、辯護士會會所之重要意義，以及建物的私法上所有權屬於原台北法曹會全體會員共有，逕予接收，改為職員宿舍，導致台北律師公會流離失所，只能長期「寄居」在司法大廈內一隅。1958、1967年台北律師公會曾要求台灣高等法院交還原法曹俱樂部建物，或以之為基地興建律師大樓，然均為其所拒，漠視國家法秩序轉換時，舊有公益財團之財產應由同性質的新設公益團體承接的原理。過往的政府作為，形式上是否合法已有待商榷，更重要的是實質上並不正當，豈有日本統治時，台北法曹會建物可供律師與司法官聯誼、當作律師公會會所，其上還有供民眾參觀的司法展示室，戰後卻全遭本國政府「劫收」之理？故當今本於轉型正義之旨，應採取一定的彌補措施。

Established in 1900, Taihoku Bar Association, the predecessor of Taipei Bar Association, had no legal capability until 1936. However, Taihoku Bar Association had never brought real estate to be the house of the Association, and thus their General Meetings of Members were always held in the meeting room of the High Court. Established in 1934, Taihoku Legal Profession Association was allowed to use the ground of the old building of the High Court for building a house of Taihoku Legal Profession Association Club with the duration of ten years by the General-Government of Taiwan. Because the overlap of members in the associations mentioned above, the Club's house was frequently the gathering place of Taihoku Bar Association. After World War II, Taihoku Legal Profession Association moved the Club's house to the newly-established Taipei Bar Association. Nevertheless, the KMT government ordered Taipei Bar Association to transfer the Club's house to the Taiwan High Court, ignoring the facts that since 1934, the Club's house was the place for social activities of legal profession in Taipei and the house of Taihoku Bar Association as well and that the ownership of the Club's house belonged to Taihoku Legal Profession Association. As a result, Taipei Bar Association, who unfortunately lost its house acquiring in 1945, was located in a small room of the court building for a long time. Taipei Bar Association tried to ask the Taiwan High Court to return its house in 1958, and to allow the Association to build a new house in the ground of the Club's house in 1967. However, the Taiwan High Court rejected these claims, disregarding that the properties of Taihoku Bar Association should be succeeded by Taipei Bar Association in the post-war era. It is controversial in law for the Taiwan High Court to take over the Club's house. More importantly, Taiwanese lawyers indeed suffered disadvantages from the ＂recovery of Taiwan＂ of their own government in this case. In accordance with the transition of justice, the current Taiwan's government should make proper compensations for its unfair confiscating the house of Taipei Bar Association in the past.
