Generative Intelligent Publishing: Copyrights and Copyright Ownership

ChatGPT and other Artificial Intelligence tools use algorithms, data and computing power to create works, breaking the limitation that the creator must be a natural person. However, copyright law seeks to reward labor, encourage social dialogue, encourage the development of science and arts, and promote the utilitarian purposes of intellectual property. Based on utilitarian considerations, the criterion for judging works that "contain thought or emotional content" can be softened when granting copyrights to AI products such as ChatGPT. As to the copyright ownership of AI products such as ChatGPT, the legislative goals of the Copyright Law, economic development, and the legal status of AI such as ChatGPT, different schemes to be chosen at present and in the future should be considered. Provisional Measures for the Administration of Generative Artificial Intelligence Services for the first time put forward a systematic legal regulation scheme for generative Artificial Intelligence services at the level of ministerial regulations. On this basis, lawmakers should keep pace with the speed of scientific and technological development, accept the challenge of reshaping Copyright Law, and formulate a new intellectual property legal framework.
