憲法法庭對大法庭裁定之違憲審查─以最高行政法院大法庭裁定為例

摘要

本文探討憲法法庭對最高行政法院大法庭裁定之違憲審查的標準。就此，本文首先嘗試清楚界定最高行政法院大法庭裁定的制度。其次則應探討「裁判憲法審查」應採取的標準，就此，考量到我國「裁判憲法審查」的運作未久，且該制度之建置係參考德國聯邦憲法法院之「裁判憲法訴願」制度，本文爰分別檢視德國聯邦憲法法院就「裁判憲法訴願」採取的違憲審查標準，以及憲法訴願案件的受理標準，據此得出關於我國憲法法庭對大法庭裁定之違憲審查的建議。

This paper explores the standard for constitutional review by the Constitutional Court of Taiwan regarding the ruling made by the Grand Chamber of the Supreme Administrative Court. Firstly, the paper will provide an overview of the system of the Supreme Administrative Court Grand Chamber ruling. Secondly, it will delve into the standard of constitutional review of the court ruling. Considering that Taiwan's system of "Constitutional Review of Judicial Decisions" is relatively new and was established with reference to the German Federal Constitutional Court's "Constitutional Complaint" system, this paper discusses the constitutional review standards and acceptance standards applied by the German Federal Constitutional Court for the constitutional complaints, and based on this, makes recommendations for the Constitutional Court of Taiwan regarding the constitutional review of the ruling made by the Grand Chamber.
