數位服務平臺治理法制之研究 —以數位中介服務法草案為核心

摘要


隨著數位發展與數位經濟發展,數位中介服務的使用已為我們日常生活中無法想像其不存在之一部,基於資訊社會不斷變化的結構,同時也為使用者個人之基本權利及社會全體帶來全新的改變與風險。為建立健全的網路環境,國際間紛紛開始重視有關數位中介服務上肆意橫行之不法內容或相關侵權行為的法制政策,藉以提出符合產業發展的法制化。此時,為因應時代需要以及國際立法趨勢脈動,NCC於2022年大量參考歐盟《數位服務法(Digital Service Act)》立法例所提出之《數位中介服務法草案》,在草案提出之際便掀起軒然大波,因涉及高度複雜的爭議問題,讓作為數位中介服務治理的一般性規範陷於無限延宕之困境。因此本文提出疑問:高度爭議的《數位中介服務法草案》是否具有立法必要性? 為解開上述疑問,本文以針對《數位中介服務法草案》之研究為核心出發。因草案立法策略主要為仿效他國經驗,本文先整理國際間不同的監管框架作為借鑑,並回到本國現有法制體系下觀察涉及數位中介服務的制度。為透徹瞭解《數位中介服務法草案》規範架構,本文將草案解構,逐條分析並與《數位服務法(Digital Service Act)》進行法制上之比較,點出爭議問題進而詳細探究,尤其是涉及數位服務提供者可能為遵行義務而箝制言論自由之疑義。最後本文找出疑問的答案,而雖然草案立法進度目前停滯不續推,惟數位平臺監管策略之後續變化與進展仍值得持續追蹤,因此本文提出符合產業法展需要、使用者權利救濟與執行效能之立法觀點與法制建言。

With the development of digital development and digital economy, the use of digital intermediary services has become an unimaginable part of our daily lives. Based on the ever-changing structure of the information society, it also brings new risks and changes to the basic rights of the users and the society as a whole. In order to establish a sound Internet environment, the international community has begun to pay attention to the legal policy regarding the illegal contents or related infringement behaviors rampant on digital intermediary services, in order to propose a legalization that is in line with the development of the industry. At this time, in response to the needs of the times and the international legislative trend, the NCC proposed the Draft Digital Intermediary Services Act in 2022 with extensive reference to the European Union''s Digital Service Act, which caused a huge uproar when it was first proposed, and because of the highly complex and controversial issues involved, the general regulation of digital intermediary service governance was caught in the predicament of infinite delay. The highly complex and controversial issues involved have put the general regulation of the governance of digital intermediary services in a state of indefinite delay. This paper therefore questions whether the highly controversial Digital Intermediary Services Act is necessary for legislation. For the purpose of solving the above question, this article focuses on the study of the Digital Intermediary Service Law Draft. Since the legislative strategy of the Bill is mainly modeled on other countries'' experiences, this article first compiles different regulatory frameworks in the international arena as a reference, and then returns to the existing legal system of the country to observe the system involving digital intermediary services. In order to thoroughly understand the regulatory framework of the Digital Intermediary Service Law Draft, this article deconstructs the Draft, analyzes it article by article, and compares it with the Digital Service Act in terms of legal system, and points out the controversial issues for further detailed investigation, especially the suspicion that digital service providers may restrict the freedom of speech in order to comply with their obligations. Finally, this paper finds out the answer to the question, and although the progress of the draft legislation is currently at a standstill, it is worthwhile to keep track of the subsequent changes and progress of the digital platform regulatory strategy, so this paper puts forward the legislative viewpoints and legal system proposals that meet the needs of the industrial law development, the user''s right to relief and the effectiveness of the implementation of the law.
